Scope
These general terms and conditions apply to all rental and service offerings of Ladner Josef GmbH on the business premises as well as to reservations via skiverleih-kappl.at.
Reservation & booking
Online reservation is handled via the booking system of INTERSPORT Rent (intersport-rent.at). On completing the reservation, a binding contract is concluded between you and Ladner Josef GmbH. The terms of the booking system additionally apply.
Free cancellation
Reservations can be cancelled free of charge up to 24 hours before the rental start. Cancellation is done directly in the booking system or by phone at the chosen shop. For later cancellation or no-show, cancellation fees apply according to the booking system’s tariff.
Right of withdrawal (distance selling)
Rental contracts for sports equipment for a specific date or period are leisure services within the meaning of § 18 para. 1 no. 12 FAGG (Austrian Distance and Off-Premises Contracts Act). For these, there is no statutory 14-day right of withdrawal in distance selling. Independently of this, we offer the free cancellation up to 24 hours before the rental start mentioned above as a voluntary courtesy.
Rental item & handover
The rental item is the material specified in the reservation (skis, snowboard, boots, poles, helmet, etc.). Handover takes place at the chosen shop (Dorf-Zentrum, Talstation Diasbahn or Mountain Life) on presentation of the reservation confirmation. Adjustment to the renter (boot fitting, binding setting) is part of the rental.
Renter’s obligations
- careful and proper handling of the rental item
- return at the agreed time
- immediate report of damage or loss
- police report in the event of theft
Liability & damage
In the event of damage to the rental item, the damage is reimbursed at its current value; an optional flat-rate ski protection insurance can be booked in addition. In the event of theft, presentation of the police report is a prerequisite for damage settlement.
Applicable law & place of jurisdiction
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is the court with subject-matter competence at the seat of Ladner Josef GmbH (Bezirksgericht Landeck), unless mandatory consumer-protection provisions provide otherwise.
